The Homezie, Inc (hereafter “HOMEZIE”) platform of services is available to authorized individuals (“User”), through the client designated website and conditioned on User’s agreement to these Terms of Use. User’s registration a/k/a Sign-Up with HOMEZIE and/or continued use of HOMEZIE services constitutes agreement to these Terms of Use. Area of Service Coverage: United State of America.
User Information and HOMEZIE Use. User agrees to supply to HOMEZIE accurate personal information including but not limited to (1) name (2) address (3) contact information. At no time do we ask for social security numbers, driver’s license numbers, or any other form of identification. HOMEZIE will not sell any User information to any third party. Additionally, EVH will not provide any User information to any third parties except for User requested services, including HOMEZIE selected and referred real estate professionals. User Sign-Up authorizes HOMEZIE to provide information to HOMEZIE service providers.
Customized account and Secure ID and Password. This Account provides access to a Control Panel from which all services can be accessed. User must Sign-In each time.
Communications. HOMEZIE uses email and telephone with Users to communicate with and provide its home marketplace services. User is able to contact HOMEZIE through the Account Control Panel. User consents to receive email and telephone from HOMEZIE and any HOMEZIE service providers and real estate professionals referred to the User.
HOMEZIE’S wholly owned subsidiary is a licensed real estate broker and is in the business of maintaining a high quality network of real estate brokers and top producing agents who meet HOMEZIE’s service criteria. HOMEZIE does not engage in brokerage business of listing or selling real estate. These activities are performed by local real estate professionals that have been referred to User by HOMEZIE. HOMEZIE refers to each User who is selling a home, two (2) real estate professionals as standard practice. HOMEZIE refers each User who is buying a home, a minimum of one (1) real estate agent. User may elect to request fewer or more referrals. User is not under obligation to use the services of a referred real estate professional. If User terminates services or does not elect to utilize a HOMEZIE referred real estate professional to either sell or purchase a home with, User will forfeit the Home View Advantage rebates and rewards. User utilization of this website for any and all reasons does not create any form of perpetual relationship, or perpetual right to receive rebates or rewards, between User and HOMEZIE, or any HOMEZIE service provider.
HOMEZIE is independent from the service providers it makes available to User. These service providers are not employees of HOMEZIE. Utilization of any HOMEZIE service provider is at the sole option of User. User understands and agrees that HOMEZIE is not responsible or liable for any acts or omissions created or performed by these third parties relative to information or services provided.
HOMEZIE provided links to any service provider or other third party web sites maintained are for User convenience and reference only. HOMEZIE does not operate or control any information, software, products or services available on third party Web sites. Our inclusion of a link to a Web site does not imply any endorsement of the services or the site, its contents, or its sponsoring organization.
HOMEZIE receives referral fees from its network of real estate suppliers. There will be no rebate, reward, or discount paid to User by HOMEZIE under the following conditions: (1) the User utilizes a real estate agent that was not referred by HOMEZIE; (2) the property is located in a state that prohibits real estate referrals, rebates, rewards or the like to an unlicensed consumer; (3) when there is no referral fee paid to HOMEZIE by the real estate agent who either sells User property or is the procuring agent for User to buy a property.
HOMEZIE services require each User to submit a final, signed Closing Disclosure as written confirmation of the real estate transaction. This Closing Disclosure statement further confirms (1) User is party to the transaction (2) all real estate agents involved and (3) payment of commission.
***Regardless in which state the transaction occurs, if for any reason it is or it becomes a violation of any code, rule or law to provide the User a rebate, reward, discount or the like, whether due to change of law, interpretation of law, amount of rebate, a tardiness of payment, or anything outside of our control, the User will not be provided a rebate, reward or discount. Nothing on this site or in our offer represents an offer to breach any law of any state, any duty or responsibility of a licensee owed to a client or interfere with any established client-agent relationship.
We reserve the right at any time to modify or discontinue any service or a portion or attribute thereof, or the offering of any information, goods, content, product or service with or without notice to any User. User continued use of this website, or any service after the posting of any amended Terms of Use shall constitute User agreement to be bound by any such changes. We shall not be liable to any User or any third party should we exercise our right to modify or discontinue service. Users have no right to modify our services.
By enrolling in HOMEZIE’s real estate home buying or selling program, User agrees that:
*User does not currently have an exclusive contractual or other arrangement with any Real Estate Professional.
User agrees to indemnify and hold HOMEZIE and its officers, employees, agents, and contractors harmless from and against any and all claims, costs, demands, damages, liabilities, or expenses, including, without limitation, reasonable attorneys’ fees, arising from or related to (a) The Information User provides; (b) User use of the web site or User reliance on the Content or User use of our services; (c) User breach of these Terms, or (d) Any actual, prospective, completed or terminated purchase, sale or other transaction between User and a third party.
HOMEZIE reserve our right to terminate, cancel or suspend User right to any rewards available in this program if the information provided by User is found to be, or alleged to be, inaccurate or misleading, OR, at any time should it become known to HOMEZIE that any state at any time no longer allows real estate rebates or other rewards. HOMEZIE reserve the right to cancel the enrollment of any User in any HOMEZIE services without liability at any time, without notice for any reason, including a User’s breach of these Terms of Use, or the terms and conditions of any service for which the User may have registered. A User may cancel use of HOMEZIE services at any time for any reason by delivering a written notice through the HOMEZIE web based form on the Contact page of the website. User shall be responsible for ensuring delivery of the cancellation notice to and obtaining acknowledgement of said cancellation from HOMEZIE.
HOMEZIE INTENDS THAT THE INFORMATION CONTAINED IN ITS WEB SITE BE ACCURATE AND RELIABLE, HOWEVER, ERRORS MAY SOMETIMES OCCUR. SHOULD USER IDENTIFY ANY SUCH ERROR, USER IS EXPECTED TO NOTIFY HOMEZIE PROMPTLY. IN ADDITION, HOMEZIE MAY MAKE CHANGES TO THE INFORMATION PROVIDED HEREIN AT ANY TIME. THE WEB SITE AND THE INFORMATION, PRODUCTS AND SERVICES ASSOCIATED WITH IT ARE PROVIDED “AS IS”.
HOMEZIE AND/OR ITS CLIENTS, SPONSORS, SUPPLIERS, PARTICIPATING LENDERS, OR REAL ESTATE PROFESSIONALS DISCLAIM ANY WARRANTY OF ANY KIND, WHETHER EXPRESS OR IMPLIED AS TO ANY MATTER WHATSOEVER RELATING TO THE WEB SITE AND ANY INFORMATION, PRODUCTS AND SERVICES PROVIDED HEREIN, INCLUDING WITHOUT LIMITATION THE IMPLIED AS TO ANY MATTER WHATSOEVER RELATING TO THE WEB SITE AND ANY INFORMATION, PRODUCTS AND SERVICES PROVIDED HEREIN, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NONINFRINGEMENT.
USE OF HOMEZIE SERVICES IS AT USER’S OWN RISK. HOMEZIE AND/OR ITS SUPPLIERS, ARE NOT LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES OR OTHER INJURY ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OF HOMEZIE SERVICES OR WITH THE DELAY OR INABILITY TO USE THE WEB SITE, OR FOR ANY INFORMATION, PRODUCTS AND SERVICES OBTAINED THROUGH THE WEB SITE, OR OTHERWISE ARISING OUT OF THE USE OF THE WEB SITE, WHETHER RESULTING IN WHOLE OR IN PART, FROM BREACH OF CONTRACT, TORTIOUS BEHAVIOR, NEGLIGENCE, STRICT LIABILITY OR
